BDS GENERAL PRIZE DRAW & AUCTION T&Cs

Below are general terms and conditions that apply to prize draw and auction activities undertaken by the BDS and/or its subsidiaries (branches).

All stalking and similar prizes/lots/items accepted by the BDS should represent an element of a sustainable management plan.

General Prize Draw Terms & Conditions

By entering a BDS Prize Draw, you are agreeing to these  general Prize Draw terms and conditions:

Eligibility

  1. Prize draws are only open to UK residents aged 18 years or over, or to under 18s that have the consent of a parent or legal guardian. Prize Draws are not open to existing employees of the BDS, elected branch officials, or its subsidiary companies, or anyone else directly connected with the Prize Draw (including any advertising and promotional agencies engaged by BDS), together with their immediate family members and/or personal partners.
  2. Individual Prize Draws may include additional eligibility requirements. All eligibility requirements will be stated clearly on any promotional materials relevant to the draw. 
  3. BDS reserves the right to request evidence of eligibility, including the identity and age of any entrant.

How to enter

  1. Individual Prize Draws may include entry requirements to take part. These requirements will be clearly stated on any promotional materials relevant to each draw.
  2. For each individual Prize Draw, ‘Dates of Entry’ or an ‘Entry Period’, as well as the date or time the draw for winners, or ‘Winner Draw Date’, will take place, will both be clearly stated on any promotional materials relevant to each draw.
  3. Entries received after the defined ‘Entry Period’ for any Prize Draw will not be eligible to be included.
  4. Entries must be made directly by the person entering a Prize Draw. Third party, bulk and/or automated applications shall not be accepted, and any entries made by a person found to be using multiple accounts to enter a Prize Draw will be ineligible.
  5. The BDS does not accept responsibility for incorrect or incomplete personal details provided by a winner, or for any damage or loss resulting from entry into a Prize Draw. The BDS shall also not be liable for issues of any kind which may prevent, restrict or delay the sending or receipt of an entry, including (but not limited to) technical faults such as network, computer, hardware or software failures. Late, damaged, illegible or corrupt entries, or those not complying with these Terms and Conditions.
  6. The BDS reserves the right to disqualify and remove entries which it determines in its absolute discretion to be racist, sexist, offensive, obscene, defamatory, abusive, insensitive, hateful, upsetting, illegal or otherwise inappropriate in any way including but not limited to those who BDS believes are entering without having fulfilled the entry requirements set out in these terms and conditions.

Prizes

  1. For each individual Prize Draw prizes available will be clearly started on all promotional materials.
  2. The provision of a prize does not imply endorsement by BDS or any of their affiliates or any other third parties concerned in any way with a Prize Draw.
  3. Each winner is personally responsible for any personal or incidental expenses and any VAT, national and/or local tax liabilities incurred in claiming or using a prize.
  4. All prizes are non-transferable, non-refundable and non-negotiable. In the event of circumstances beyond BDS’s control, BDS reserves the right to substitute the prizes for similar prizes of equal or greater value or, at its sole discretion, the cash value of the prize.
  5. Insofar as permitted by law, BDS will not in any circumstances be responsible or liable to compensate the winner or accept any liability for loss, damage, personal injury or death occurring as a result of using and/or taking up (or failing to use and/or take up) the prize except where it is caused by the negligence of BDS or its employees.

Winner selection

  1. The winners of a Prize Draw will always be selected at random either by a computer process or by hand draw from all eligible entries/tickets received during the Entry Period. Reserve winners will also be selected in case the original winners cannot be contacted and/or do not provide the necessary information.
  2. Randomly drawn winners will be notified within 2 weeks of the draw date. Two attempts will be made to contact the winners within a 14 day period. If a winner does not respond within 5 days of their second contact, they will lose their right to the prize and BDS reserves the right to award the prize to the reserve winner selected as set out above.
  3. The decision of the BDS regarding any aspect of a Prize Draw is final and binding and no correspondence will be entered into. Furthermore, BDS reserves the right to disqualify a winner if it reasonably believes there has been a breach of these Terms and Conditions or a winner’s conduct is contrary to these Terms and Conditions and in these circumstances BDS also reserves the right to require the return of any prize awarded (if applicable) and select an alternative winner as set out above.

Special Prize Conditions

  1. For prizes that include shooting or stalking days/items winners must hold necessary firearms or shotgun certification, is a safe and experienced shot, is physically fit and covered by third-party insurance to at least £10 million. The BDS and/or prize donors reserve the right to see evidence of FAC and insurance coverage. Participants may be asked to demonstrate their ability on a target range before being allowed to stalk.
  2. For fishing prizes, winners must ensure they hold any relevant national rod licence necessary.

General

BDS reserves the right to:

  1. Cancel or suspend any Prize Draw;
  2. Cancel or refuse any individual’s entry; and/or amend these Terms and Conditions (and will use reasonable endeavours to notify changes to entrants and potential entrants).
  3. Any personal data received from entrants will only be used and/or shared with third parties where necessary for the proper purposes of a Prize Draw and in accordance with BDS’s Privacy Policy at www.bds.org.uk/privacy-policy/.

By entering a Prize Draw, each winner agrees:

  1. That BDS may request the winners express written consent to use their surname and county of residence to announce the winner of the Prize Draw as set out below, and for any other reasonable and related promotional purposes; and to participate in such promotional activity and material relating to the Prize Draw as BDS may require. For the avoidance of doubt neither entry into the Prize Draw nor the likelihood of the entrant being the prize winner are conditional upon consent being given.
  2. Where the winner has given their consent as set out above, the surname and county of the winners will be available for one month after the Draw Date to anyone who sends an email to info@bds.org.uk. If an entrant objects to this information being made available, they should inform BDS at the earliest opportunity. In such cases, BDS will not make their details available to members of the public, but entrants should be aware that BDS may still be required to share their details with the Advertising Standards Authority.
  3. These Terms and Conditions shall be governed and construed in accordance with English law and entrants agree to irrevocably submit to the exclusive jurisdiction of the English courts in respect of any dispute arising out of or in connection with them.

General Auction Terms & Conditions

By entering a BDS Auction, you are agreeing to these general Auction terms and conditions:

The Promoter BDS or BDS branch Auction is the British Deer Society (BDS). Registered address: The Walled Garden, Burgate Manor, Fordingbridge Hampshire SP6 1EF

  1. The BDS has the right to refuse any bid. If the winning bid is invalid or is not paid, the next highest bid shall be the winning bid.

    3. All items/lots in BDS Auctions must be taken during stated dates, and are taken at one’s own risk. Bidding online or in-person is a contractual commitment to buy and when you bid, there is no right of return, unless the item is materially different to its catalogue description.

    4. All items/lots are sold according to descriptions which are subject to alteration until the point of sale and are based upon information provided by the donors of the items/lots. Descriptions have not been verified by the BDS and should not be relied upon as statements of definitive fact. Neither the BDS nor the relevant donor can be held responsible for errors of description or for genuineness or authenticity of any items/lots, or for any fault or defect in it. Neither the organisers nor the donor give any warranty whatsoever in respect of any items/lots where quarry numbers are mentioned. The figures are indicative only and all items/lots are sold subject to no return. Images against items/lots descriptions are for illustrative purposes only and may not indicate the exact items/lots you will receive.

    5. If the donor of a items/lots does not make available to the winning bidder the relevant items/lots substantially as described, and alternative arrangements are not made, the BDS shall refund the purchase price to the winning bidder, but shall have no liability to him or her for any consequential costs, loss or damages, whether associated with the cancellation of travel plans or otherwise.

    6. Purchasers of shooting or stalking days/items/lots must ensure that any participant holds necessary firearms or shotgun certification, is a safe and experienced shot, is physically fit and covered by third-party insurance to at least £10 million. Donors reserve the right to see evidence of insurance coverage. Participants may be asked to demonstrate their ability on a target range before being allowed to stalk.

    7. For fishing items/lots, individuals must ensure they hold any relevant national rod licence necessary.

    8. Bidders bidding by mail authorise BDS to bid as an agent on their behalf and shall be bound as if they had placed the bid personally.

    9. At the end of an auction, if full payment has not been received within two weeks of notification, the sale may be rescinded by the BDS without notice. The rights to a items/lots purchased shall not pass until the BDS receives full payment.

    10. Where appropriate the onus is on the buyer/winner to contact the donor or his representative and arrange mutually convenient dates and times for stalking, shooting, fishing, accommodation etc. The British Deer Society (or its subsidiaries) will forward contact details to the buyer within two weeks of the sale. The BDS can accept no further responsibility for the arrangements.

    11. In the event of cancellation of a item/lot for whatever reason, bad weather, an outbreak of disease, terrorism etc. an alternative date will be a matter of negotiation between the donor and bidder. The BDS can accept no further responsibility for the arrangements.

    12. These conditions of sale are subject to English law. The BDS and each bidder submit to the exclusive jurisdiction of the English Courts.

    13. Items/lots in this Auction may not be resold or awarded as prizes for competitions.
